You retain ownership of any content you provide to us, but you grant quantumharboris a non-exclusive, worldwide, royalty-free licence to use, modify, and distribute such content solely for the purpose of providing our Services to you.

• All fees are quoted in Euros (EUR) unless otherwise specified
• Payment is due according to the terms specified in your service agreement
• Late payments may incur additional charges as specified in your agreement
• All fees are non-refundable except as expressly provided in your service agreement

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall quantumharboris, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, our Services.

In no event shall quantumharboris's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty euros (€50) or the amount you paid to quantumharboris in the twelve (12) months preceding the event giving rise to the claim, whichever is greater.

9. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. quantumharboris and its suppliers and licensors hereby disclaim all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

We do not warrant that our Services will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of our Services will be accurate or reliable.

10. Indemnification

You agree to defend, indemnify, and hold harmless quantumharboris and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

11. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use our Services will cease immediately.

You may terminate your use of our Services at any time by discontinuing your use of our website and services. If you have a service agreement with us, termination will be subject to the terms specified in that agreement.

12. Governing Law

These Terms shall be interpreted and governed by the laws of Austria, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our Services.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
